تشخیص دروغ متهمان با استفاده از ابزارهای کاربردشناسی زبان

چکیده
زبان‌شناسی حقوقی، شاخه‌ای کاربردی از مطالعات زبان‌شناختی است که با بهره‌گیری از نظریه‌ها و روش‌های این حوزه به تحلیل پدیده‌های زبانی در بافت حقوقی می‌پردازد. پژوهش حاضر با هدف بررسی و تشخیص دروغ در گفتار متهمان کلاهبرداری و سرقت، از رهیافت کاربردشناسی زبان بهره برده است. روش تحقیق، توصیفی–تحلیلی و داده‌ها از هشت پرونده واقعی در دادگستری استان سمنان گردآوری شده‌اند. در این راستا، سه اصل کلیدی کاربردشناسی یعنی «تلویح»، «کنش‌های گفتاری» و «تعلیق» به عنوان چارچوب تحلیلی به‌کار گرفته شدند. یافته‌ها نشان می‌دهد که متهمان کلاهبرداری به‌طور میانگین دو برابر بیشتر از متهمان سرقت از «تلویح‌های متعارف» (مانند واژه‌های «اما»، «حتی» و «هنوز») در هنگام ادای اظهارات دروغین استفاده می‌کنند. همچنین، در حالی که متهمان سرقت معمولاً «شرایط اقتضای گفتار» را رعایت می‌کنند، نقض این شرایط در گفتار متهمان کلاهبرداری مشهود است. از سوی دیگر، «درنگ» در پاسخ‌دهی عمدتاً در گفتار متهمان سرقت مشاهده شد. همچنین، کاربرد «پاره‌گفتارهای نابجا» و «کنش‌های غیرمستقیم» در میان متهمان سرقت به مراتب بیشتر بود. در نهایت، یافتۀ شاخص دیگر حاکی از آن بود که تنها متهمان کلاهبرداری از «تعلیق» به عنوان یک راهبرد زبانی برای پنهان‌کاری و طفره‌روی نظام‌مند استفاده کرده‌اند.

Detecting the Lies of Defendants Using Language Pragmatics

چکیده English

Forensic linguistics is an applied branch of linguistic studies that draws on linguistic theories and methodologies to analyze language-related phenomena within legal contexts. The present study adopts a pragmatic approach to examine and detect deception in the speech of defendants involved in two types of crimes, namely fraud and theft. Employing a descriptive–analytical research design, the data were collected from eight authentic fraud and theft cases archived in the judiciary of Semnan Province. Within this framework, three core pragmatic principles—implicature, speech acts, and suspension—were employed as the analytical model. The findings indicate that fraud defendants use conventional implicatures (such as but, even, and still) approximately twice as frequently as theft defendants when producing deceptive statements. Moreover, while theft defendants generally observe felicity conditions, violations of these conditions are salient in the speech of fraud defendants. In contrast, pausing and hesitation in responding to questions are predominantly observed in the speech of theft defendants. Additionally, theft defendants make substantially greater use of infelicitous utterances and indirect speech acts than fraud defendants. Finally, another salient finding reveals that suspension—as a linguistic strategy for systematic evasion and concealment—is exclusively employed by fraud defendants.
